At some point in the last decade, a quiet but consequential renegotiation took place between software companies and their customers. The terms were never formally presented for acceptance. There was no industry-wide announcement, no congressional hearing, no moment at which users were asked to weigh in on whether they preferred the old arrangement or the new one. The transition happened incrementally, version by version, terms-of-service update by terms-of-service update, until the concept of owning software — truly owning it, in the way one owns a physical object — had become largely vestigial.
What replaced it is a system of conditional access: software delivered as a service, governed by licenses that expire, subject to terms that change, and dependent on infrastructure that the vendor controls. The monthly or annual fee is the visible component. The less visible components — the data collection provisions, the remote deactivation clauses, the restrictions on modification and transfer — constitute a restructuring of the user-vendor relationship that goes considerably beyond a change in payment schedule.
How the Perpetual License Disappeared
The perpetual software license was, for most of computing history, the default transaction. A user purchased a specific version of a program, received the right to use that version indefinitely, and retained that right regardless of what the vendor subsequently did. Microsoft Office 2003 could be installed, used, and relied upon in 2015 without any ongoing obligation to Microsoft. Adobe Photoshop CS6, purchased outright, would function on compatible hardware for as long as the hardware remained operational.
This model had genuine advantages for users. It created a stable relationship between a user and their tools. It allowed organizations to budget software costs as capital expenditures rather than perpetual operating expenses. It meant that a small business or individual creator could invest in professional-grade software once and amortize that investment over years.
It also, from the vendor's perspective, had a significant structural problem: it was difficult to grow revenue from satisfied customers. A user who purchased Office 2003 and found it adequate had no particular incentive to purchase Office 2007 or 2010. The perpetual license model rewarded software quality in the short term but created long-term revenue pressure that pushed vendors toward artificial obsolescence strategies — deprecating file format compatibility, ending security support for older versions, and engineering friction into upgrade paths.
The subscription model solved this problem elegantly, from the vendor's perspective. It converted a one-time transaction into a recurring revenue stream, aligned vendor incentives with continuous development rather than version releases, and — crucially — gave vendors ongoing leverage over users that the perpetual license had not provided.
The DRM Layer: Where Licensing Becomes Control
Digital rights management is the technical infrastructure that makes subscription licensing enforceable. Without it, a subscription model is merely a payment arrangement that a determined user could circumvent by retaining a copy of the software after canceling. With it, the subscription model becomes a hard dependency: remove the payment, remove the access.
The implications extend beyond the simple on/off switch of active versus lapsed subscriptions. DRM systems require ongoing authentication, which means software functionality is contingent on the continued operation of vendor-controlled authentication servers. When a company discontinues a product, shuts down, or simply decides to retire a server infrastructure, users who purchased access to that software lose it — regardless of what they paid, regardless of what the marketing materials implied about permanence.
This is not a theoretical concern. It has happened repeatedly and at scale. Microsoft's closure of its ebook store in 2019 deleted purchased content from users' devices. Adobe's acquisition of Figma, though ultimately blocked by regulators, raised legitimate questions about what happens to creative work stored in platforms controlled by companies undergoing consolidation. The collapse of various gaming storefronts has periodically rendered purchased game libraries inaccessible.
Each of these events represents a transfer of risk from vendor to user — a risk that was present in the licensing terms all along but that most users did not meaningfully evaluate at the point of purchase.
What the Terms of Service Actually Say
The terms of service documents governing major software subscriptions are not designed to be read. They are designed to be accepted — quickly, without friction, in the context of an installation process that the user wants to complete as rapidly as possible. This design choice is not accidental. The information these documents contain would, if clearly communicated at the point of sale, meaningfully affect purchasing decisions.
A careful reading of the terms governing several major subscription software products reveals provisions that most users would find surprising. Many include clauses permitting the vendor to modify the service — including removing features — with minimal notice. Several reserve the right to analyze files processed through the software for purposes described only in general terms. A number include arbitration clauses that limit users' ability to pursue class action remedies for systematic violations. Virtually all include provisions allowing the vendor to terminate access for violations of acceptable use policies defined broadly enough to accommodate future reinterpretation.
None of these provisions are illegal. Most are standard practice across the industry. Their cumulative effect is to create a software relationship in which the user has paid for access but retained few of the protections that would accompany ownership of a physical good.
The Hidden Cost Accounting
The subscription model's financial implications are frequently underestimated at the point of adoption. A $20 monthly subscription to a productivity application appears modest in isolation. Across a decade, it represents $2,400 — a sum that, in the perpetual license era, would have purchased the application outright several times over and left the user with something they continued to own.
For creative professionals maintaining subscriptions to Adobe Creative Cloud, Microsoft 365, and various specialized tools, the annual software expenditure can exceed $2,000 to $3,000 — a figure that would have been considered extraordinary in an era of perpetual licensing. For small businesses maintaining these subscriptions across multiple employees, the compounding effect on operating costs is substantial.
The counterargument — that subscriptions fund continuous development and that users benefit from ongoing updates — is not without merit. The relevant question is whether the updates delivered justify the ongoing cost, and whether users have meaningful ability to evaluate that question or to exit if the answer is no. In practice, exit costs are high: data locked in proprietary formats, workflows built around specific tools, and the time cost of migration all function as barriers that keep users subscribed past the point at which the value proposition would otherwise justify continuation.
Where the Exits Still Exist
The exits are narrower than they once were, but they have not entirely closed. Several categories of software remain available under genuinely perpetual licensing terms, and identifying them is worth the effort for users who prioritize long-term control over short-term convenience.
JetBrains, despite offering subscription options, continues to sell perpetual licenses for its developer tools with a fallback provision that preserves access to the version current at the time of purchase, even after subscription lapse. Affinity, owned by Canva, offers its creative suite — Designer, Photo, and Publisher — under one-time purchase terms that directly challenge the Creative Cloud model on both price and principle. Many specialized professional applications in fields like engineering and scientific computing continue to offer perpetual licensing because their customer base has the leverage to demand it.
In the open source ecosystem, perpetual access is definitional: the software cannot be revoked because the user has the source code. LibreOffice, GIMP, Inkscape, Kdenlive, and dozens of other community-maintained tools provide functional alternatives to subscription-gated software in most common use cases. The trade-offs are real — these tools vary in polish and feature parity with their commercial counterparts — but for users whose primary concern is long-term autonomy, they represent a category of software that no vendor can unilaterally revoke.
The Ownership Calculation
The question of whether subscription software is ever worth its terms is not one with a universal answer. For users with straightforward needs, predictable workflows, and limited concern about vendor dependency, subscription software may represent a reasonable trade. The continuous update model has genuine advantages in categories like security software, where currency matters.
For users who require long-term stability, who process sensitive data, who operate in environments where vendor dependency creates institutional risk, or who simply prefer to own their tools rather than rent them indefinitely, the calculation is different. The subscription model was designed to serve vendors' interests. Understanding it clearly is the minimum prerequisite for deciding whether it also serves yours.
